By accessing our website or purchasing our products, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
2. Eligibility
You must be at least 21 years old to purchase our products. By placing an order, you represent that you are at least 21 years of age and are legally able to enter into a binding contract.
- By purchasing, you confirm you are 21+. Orders suspected of being placed on behalf of minors will be canceled.
We reserve the right to cancel and refund any order we believe is being placed on behalf of a minor. Purchases must be made by and shipped to an adult recipient. We can require an Adult signature on delivery if order is placed on behalf of someone else to their address. Ex. You use your credit card but send to a friend. We will add an adult signature requirement on drop off as an age gate.
3. Products
The Fountain Cannabis Company LLC offers hemp-derived CBD and cannabinoid products that comply with the Agricultural Improvement Act of 2018 (the 2018 Farm Bill). All products contain less than 0.3% delta-9 THC on a dry weight basis.
4. Orders and Payment
All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, errors in product descriptions or prices, or suspected fraud. Payment must be made in full at the time of purchase.
5. Shipping and Delivery
We aim to process and ship orders within a reasonable timeframe. However, we are not responsible for delays caused by shipping carriers or other circumstances beyond our control. Risk of loss passes to you upon delivery of the products.
6. Returns and Refunds
Due to the nature of our products, we do not accept returns unless the product is defective or damaged upon arrival. If you receive a defective product, please contact us within 7 days of receipt for instructions on how to proceed with a return.
7. Disclaimer of Warranties
Our products are provided on an “as is” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. We do not guarantee that our products will meet your expectations.
8. Limitation of Liability
To the fullest extent permitted by law, The Fountain Cannabis Company LLC shall not be liable for any indirect, incidental, special, consequential damages arising out of or in connection with your use of our products or services. Hemp is an agricultural commodity cultivated for its fiber, oilseed, and extracts, which are used in a wide range of commercial products. The 2018 Farm Bill legalized hemp production in the United States, removing it from the Controlled Substances Act, provided its tetrahydrocannabinol (THC) concentration is below 0.3%.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio without regard to its conflict of law principles.
10. Changes to Terms
We reserve the right to modify these Terms at any time without prior notice. Your continued use after such changes constitutes your acceptance of the new Terms.
